Terms & Conditions

These terms apply to products ordered via the www.sillyowl.co.uk web site and Silly Owl's mobile phone apps.

1- Initial introduction

1.1- You are agreeing to the following terms and conditions by making a purchase on the Silly Owl website and mobile apps.
1.2- When making a purchase with Silly Owl it is your responsibility to ensure that you are fully aware of these terms and conditions.
1.3- When making a purchase on the website you should read the terms and conditions because they can be altered at any time.


2– Order Process

2.1- Your order will be acknowledged via email, if you enter a correct email address, on the understanding that delivery is subject to availability.
2.1- We take payment from your card, when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the products.
2.2- Our display of products on our website and mobile apps may not be exact match of product that would be delivered. In nature of display photos, we may not be able to show all details of the products. 


3– Payment & Prices

3.1- We cannot process any other payment method unless it’s indicated on our web site and mobile apps.
3.2- Payment shall be made by any single one of the methods indicated on our website and mobile apps. We are unable to process orders with more than one method of payment.
3.3- Payment will be taken from your account when the item is ready for dispatch.
3.4- You will be charged the current price for buying goods from our website and mobile apps at the date you place your order. All prices are displayed on our website and Mobile apps are in British Pound Sterling and inclusive of VAT, (where applicable). We reserve the right to amend prices if there is a change in the rate of VAT.
3.5- Delivery costs (where applicable) will be added to the total price of the goods.
3.6- We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still want to purchase the goods at the correct price.


4– Delivery

4.1- You will receive a confirmation email at the address you have specified when your order has been dispatched - this email contains the tracking number so you can track it online from Silly Owl to your door.
4.2- We will endeavour to meet any given date for delivery however we cannot be held responsible for any delays. If we are unable to make the expected delivery date we shall inform you by email or phone as soon as possible. Should this happen, you have the right to either continue with the order or cancel it.
4.3- Orders may require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advice  that a delivery has been attempted.
4.4- If your order is returned to us (e.g. incorrect address specified, item not called for), then we will inform you immediately by email as soon as we receive the item. From this point forth, if you wish us to re-dispatch the item or for you to cancel the order. Please note that for items that were undelivered through fault of the consumer and a refund is requested, we reserve the right to deduct our outwardly shipping fees from the refund total.
4.5- International shipping is calculated in the checkout, and is usually £10 to most destinations, and the delivery timescale is a non-guaranteed 3 - 10 working days. Please check the delivery prices.
4.6- We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.


5– Cancelation, Refund and Change

5.1- If, for any reason, you are unhappy with the gift chosen you may cancel it anytime up to seven working days after delivery. Unwanted goods must be returned in a fully resalable condition, must be unused, undamaged and any tags must be intact.
5.2- Earrings, belly bars or other items of pierced jewellery cannot be returned unless they are found to have manufacturing faults.
5.3- Any items less than £10 cannot be returned unless they are found to have manufacturing faults.
5.4- Orders fulfilled for bags can be canceled and returneded with 25% compensation fee unless they have a flaw. Because, most of our bags are handmade bags and produced on order request.
5.5- If you cancel before your gift is delivered to the bride and groom or wish to cancel a substituted gift after it has been delivered you are asked to contact, in writing, the store holding the wedding list to obtain a full credit / refund
5.6- If you cancel after the gift has been delivered to the bride and groom you are asked to arrange for the gift to be returned, in person or by post at your expense, to the store holding the wedding list for a full credit / refund. Orders placed for items made to specification or clearly personalised may not be cancelled.
5.7- When the item is received, It will be inspected to ensure everything is present and in its original condition to ensure its eligibility for refund. Refunds are processed as quickly as possible and you will be notified via email when the refund process is completed. We aim to process all refunds within 7 days.
5.8- You should return it to us using Royal Mail Special Delivery. This way the delivery is insured.  You should also record the tracking number.

5.8- Your card is refunded to the full amount of product. We do not charge any 'restocking' fees.  However, all shipping charges are not refundable. If you have any queries about this policy then please use the Contact Us option.
5.9- With your order, you should receive a returns form at the bottom of your invoice.  To expedite your refund, please complete this in its entirety.  If you have misplaced or not received the returns form, it can be downloaded on our website.
5.10- We do not accept product change request apart from size change request.  For change request for product sizes, we charge £7.5 as Service Fee.


6– Privacy

6.1- We do not store credit card details nor do we share customer details with any 3rd parties.
6.2- All personal information is entirely confidential and not sold or leased to any third party organisation.
6.3- Subscription to our newsletter is optional in the check out page. Information provided is not used for any other purpose.


7– Security

7.1- For reasons of fraud protection your IP address is logged when placing an order. All orders are scanned strictly for fraud by our fraud department before they are shipped. If you specify a different shipping address to the billing address then your order may take longer as we have to perform the necessary checks. Fraudulent orders will be submitted to the appropriate authorities.


8- General

8.1- We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings as a result of our failure to comply with these terms or our negligence. Save that our liability in respect of any death or personal injury caused by our negligence shall not in any way be restricted.
8.2- All measurements are approximate.
8.3- Silly Owl reserves the right to change prices without prior notice.
8.4- We reserve the right to cancel the contract and re-list a product if you have purchased an item that is miss-priced.
8.5- We reserve the right to cancel any order at any time prior to delivery, for any reason.
8.6- No contract of sales exists until your order is verified by a Silly Owl's employee, and the order status is set to 'Verified'.  Our initial order status, ‘Processed’ does not mean that a contract of sale is in place.  This only means that the order has been successfully received into our system.  From there on, validity and verification must take place before the contract of sale exists.
8.7- All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website and mobile apps shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.
